These Terms of Service ("Terms") govern your use of ThetaFlow ("ThetaFlow", "we", "us"), a software service that automates options strategies on a brokerage account you connect. By creating an account or using ThetaFlow, you agree to these Terms. If you do not agree, do not use the service.
ThetaFlow is a software tool. It lets you configure options strategies and executes them on your own Tastytrade brokerage account, which you connect through Tastytrade's OAuth authorization. ThetaFlow is not a broker-dealer, investment adviser, financial planner, or fiduciary. We do not hold your funds or securities, do not give investment, legal, or tax advice, and do not make recommendations. ThetaFlow only places the orders you have configured; every trading decision is yours.
You must be at least 18 years old, legally able to enter into these Terms, and the holder of (or authorized on) the brokerage account you connect. You are responsible for ensuring your use of ThetaFlow complies with your brokerage's terms and with all laws and regulations that apply to you.
You connect your brokerage account through Tastytrade's OAuth flow; we never see or store your brokerage password. We store an encrypted access token so the service can act on your account as you have configured. You may disconnect, disable, or delete your account at any time, which stops further automated activity.
Options trading involves substantial risk of loss and is not suitable for every investor. You are solely responsible for your strategies, parameters, and the orders ThetaFlow places on your behalf, and for any resulting gains or losses. We provide a dry-run mode so you can preview orders before going live; use it. Past performance does not guarantee future results, and nothing in the service is a guarantee of any outcome.
You agree not to misuse the service: no attempts to disrupt, overload, reverse engineer, or gain unauthorized access; no use that violates law or your brokerage's rules; and no use that abuses shared infrastructure or third-party rate limits. We may suspend or terminate accounts that do.
Paid plans are billed in advance on a recurring basis through our payment processor. You authorize us (and the processor) to charge your payment method for the plan you choose until you cancel. Cancellation and refunds are governed by our Refund & Cancellation Policy.
We work to keep ThetaFlow available and accurate, but the service is provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation, and market data, brokerage connectivity, and third-party services are outside our control.
To the fullest extent permitted by law, ThetaFlow disclaims all warranties, express or implied. We are not liable for trading losses, missed or duplicated orders, brokerage or market-data outages, or any indirect, incidental, or consequential damages. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim.
You agree to indemnify and hold ThetaFlow harmless from claims arising out of your use of the service, your trading activity, or your violation of these Terms.
You may stop using the service and delete your account at any time. We may suspend or terminate access for violation of these Terms or to comply with law. Provisions that by their nature should survive termination (e.g. disclaimers, limitation of liability) will survive.
We may update these Terms from time to time. Material changes will be reflected by the "last updated" date above; continued use after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules.
